Welcome to Smash Transfers (“we,” “us,” or “our”). We operate this website and store—including all related information, content, features, tools, products, and services—to provide you with a curated shopping experience (the “Services”). Our site is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced here (including our Privacy Policy and Refund Policy), describe your rights and responsibilities when using the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use or access the Services.

1. Access and Account

You represent that you are at least the age of majority in your state or province of residence and that you consent to any minor dependents using the Services on devices you own or manage. You may be asked to provide information (e.g., email, billing, payment, shipping). You confirm all information you provide is accurate, current, and complete and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials and all activity under your account. Accounts may not be sold, transferred, assigned, or licensed.

2. Our Products

We strive to represent products accurately; however, colors and appearance can vary by device and settings. We do not warrant that product appearance, quality, or performance will meet your expectations or precisely match on-screen depictions. Product descriptions, pricing, and availability may change at any time without notice. We may discontinue products and limit quantities by person, region, or jurisdiction at our discretion.

3. Orders

Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion and must receive and process payment before acceptance. Review orders carefully before submitting; cancellations may not be possible after acceptance. If we decline, change, or cancel an order, we will attempt to notify you using the contact details provided at checkout. Purchases are subject to our Refund Policy. You represent that purchases are for personal or household use—not for commercial resale or export.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price in effect at the time of your order will appear in your confirmation email. Unless expressly stated, prices exclude taxes, shipping, handling, customs, and import charges. Online prices may differ from those in physical locations or third-party stores. Promotions may be governed by separate terms; if there is a conflict, promotional terms control. You agree to provide current, complete, and accurate purchase and account information and promptly update email, payment card details, and expiration dates. You represent that you are authorized to use the payment method and will pay all charges, including applicable taxes, shipping, and handling.

5. Shipping and Delivery

Delivery times are estimates and not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you upon our transfer of products to the carrier.

6. Intellectual Property

All content and materials on the Services—including trademarks, brands, text, images, graphics, video, audio, product reviews, and their selection and arrangement—are owned by Smash Transfers, its affiliates, or licensors and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works, publicly display or perform, republish, download, store, or transmit materials from the Services without our prior written consent. Smash Transfers’ names, logos, and related marks are our trademarks. All other trademarks are the property of their respective owners.

7. Optional Tools

We may provide access to third-party tools “as is” and “as available,” without warranties, representations, or endorsements. Use is at your own risk and subject to the third party’s terms. Future features released through the Services are also subject to these Terms.

8. Third-Party Links

The Services may contain links to third-party sites or embedded functionality. We do not control and are not responsible for such sites, their content, policies, or practices. Accessing third-party sites is at your own risk. Direct questions about third-party products or services to the third party.

9. Relationship with Shopify

Our Services are hosted by Shopify. However, your purchases are made directly with Smash Transfers. Shopify is not responsible for sales between you and Smash Transfers. You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from your purchases and transactions with Smash Transfers.

10. Privacy Policy

Personal information collected through the Services is subject to our Privacy Policy, and certain information may be processed by Shopify under Shopify’s privacy policies. Because Shopify hosts our Services, information you submit may be transmitted to Shopify and its service providers (including across borders) to provide and improve the Services. 11. Feedback

If you submit ideas, suggestions, reviews, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any purpose. You represent that you own or have rights to the Feedback; have disclosed any incentives; and that the Feedback complies with these Terms. We may monitor, edit, or remove Feedback at our discretion. You may not misrepresent your identity or submit unlawful, abusive, obscene, or infringing content or malware. You are solely responsible for your Feedback.

12. Errors, Inaccuracies, and Omissions

We may correct errors or update information (including pricing, descriptions, promotions, shipping charges, transit times, and availability) and cancel orders if information is inaccurate at any time without prior notice, including after an order is submitted.

13. Prohibited Uses

You may use the Services only for lawful purposes. You may not, directly or indirectly: violate laws; infringe intellectual property; harass or harm others; submit false or misleading information; send unsolicited promotions; impersonate others; upload malicious code; scrape, spider, or crawl; collect personal information of others; circumvent security features; or engage in conduct that restricts or harms others’ use of the Services or exposes us, Shopify, or users to liability. We may suspend or terminate access for violations.

14. Termination

We may terminate these Terms or your access to the Services at any time without notice. You remain liable for amounts due up to and including the termination date. Sections intended to survive (including Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will continue to apply.

15. Disclaimer of Warranties

Except as expressly stated by Smash Transfers, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted, timely, secure, or error-free operation. Some jurisdictions do not allow limitations on implied warranties, so these limits may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Smash Transfers and our partners, officers, directors, employees, affiliates, agents, contractors, service providers, and licensors (and Shopify and its affiliates) will not be liable for any indirect, incidental, punitive, special, consequential, or exemplary damages (including lost profits, revenues, savings, data, or replacement costs) arising from or related to your use of the Services or any products, even if advised of the possibility. In no event will our total liability exceed the amount you paid for the product(s) giving rise to the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless Smash Transfers, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from losses, liabilities, damages, and costs (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law or third-party rights, or use of the Services. We may control the defense and settlement of indemnified claims.

18. Severability

If any provision of these Terms is unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remainder will remain in effect.

19. Waiver; Entire Agreement

Our failure to enforce a provision does not waive our right to do so later. These Terms, together with posted policies (including the Privacy Policy and Refund Policy), are the entire agreement between you and us regarding the Services and supersede prior agreements.

20. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations without notice.

21. Governing Law

These Terms and any related disputes are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. You consent to exclusive jurisdiction and venue in the state or federal courts located in New Jersey.

Headings are for convenience only and do not affect interpretation.

You can review the most current version of these Terms at any time on this page. We may update these Terms by posting changes on our website. We will provide notice of material changes as required by law. Your continued use of the Services following changes constitutes acceptance.
